Terms and Conditions

1.1

LC Idiomas GC SLU, with registered office at Calle República Dominicana, 17, 35010, Las Palmas de Gran Canaria, offers Spanish courses subject to these Conditions, the reservation and acceptance of which shall constitute the "Contract".

1.2

The academy may modify these Terms and Conditions at any time in relation to future courses, which will be published on this website.

1.3

If the Course booked by the Student is no longer available, the School will immediately inform the Student in writing or by email and will endeavour to offer an alternative Course which is reasonably acceptable to the Student, but if this option is not possible, the School is entitled to cancel the Contract by notifying the Student in writing to this effect and refunding any monies already paid by the Student for the Course.

RESERVATIONS AND CONDITIONS FOR SPANISH COURSES AND PROGRAMMES

2.1 Reservations for General Courses and Leisure Programmes. The reservation fee for these courses must be paid in full before the start of the course in order to guarantee a place on the requested course.

2.2 Booking of individual and mini-group classes. The academy reserves the right to release the timetable for individual or mini-group sessions if no response is received from the student to renew the voucher within 24 hours of notice of the end of the voucher.

2.3 Validity of the voucher of hours (individual and mini-group). Vouchers for individual or mini-group classes will be valid for a maximum of 8 weeks. In the event that the voucher is for 30 hours or more, this period is extended to 15 weeks.

2.4 SIELE and DELE exam preparation courses. Access to the course will be subject to the recommendations made by the Academic Coordination team based on the student's level.

2.5. In the General Plus and Intensive courses, it is compulsory to take the individual sessions within the 4 weeks of the course. Once this period has elapsed, the sessions not taken cannot be made up.

2.6. The level tests for access to the Spanish programmes may not be taken during the fixed academic timetable.

2.7. The student may request changes or modifications to the accommodation by contacting the customer service department of our educational institution on 928 90 90 54.

TERMINATION, CANCELLATION, NO-SHOW AND/OR DROP-OUT OF THE PROGRAMME BY THE CONSUMER

3.1. In the event that a consumer decides to cancel the contracted programme, he/she must notify Language Campus in writing.

The consumer is entitled to a refund of the amounts paid to Language Campus. However, the consumer must pay and, if applicable, Language Campus may retain the amount corresponding to the damages caused to Language Campus, including expenses of any nature incurred by Language Campus to date, including but not limited to: payments to third parties involved in the programme: schools, residences, insurance companies, telephone calls, as well as any other infrastructure and/or logistical expenses, among others.

In order to inform the consumer of the approximate amount of the withholding taxes or charges to be levied and irrespective of their subsequent determination, the withholding taxes or charges for disposal shall amount to

  • Management fees calculated at a minimum of €300 non-refundable.

  • 50% of the total amount of the programme, if cancellation occurs between 20 and 45 days before the start date of the programme.

  • 75% of the total amount of the programme, if the cancellation occurs between 10 and 20 days before the start date of the programme.

  • 85% of the total amount of the programme, if the cancellation occurs between 3 and 10 days before the start date of the programme.

  • 100% if the cancellation occurs within the previous 48 hours, or if the consumer does not show up for the departure or once the programme has started, leaves the programme of his own free will, or of his parents or legal representatives, or is expelled from the programme.

3.2 Withdrawals from the General Course and Leisure Programmes must be notified before the 25th day of the month prior to the month in which you wish to terminate the contract. To do so, you must send an e-mail to mesaylopez@lcampus.co o 7palmas@lcampus.co with the student's full name, ID card number and the reason for the withdrawal.

3.3. In the case of the General Course, cancellations can only be made for work reasons, the student cannot attend (subject to verification with a certificate issued by the employer), health reasons (medical certificate) or change of residence outside the municipality of Las Palmas de Gran Canaria.

STATEMENT ON HEALTH STATUS

4.1 Students must state on the application form if they suffer from any type of disability:

  • physical or mental illness,

  • allergy,

  • disability;

  • or any other condition that

    • may interfere with their ability to complete the course satisfactorily;

    • may affect the health or welfare of any other pupil, teacher or member of staff;

    • may require medical follow-up, treatment or emergency intervention of any kind during training.

Language Campus reserves the right to refuse any student, or to terminate their training, if their continued participation in the course could pose a risk to their own health and safety, or that of any member of staff. In such cases, Language Campus will decide the refund policy to be applied, at its sole discretion.

PUBLIC HOLIDAYS

5.1 There will be no lessons on public holidays and the school premises will be closed. All scheduled group course start dates fall on a Monday, unless it is a public holiday, in which case they will start on the following day, Tuesday. No compensation will be made for classes not offered on public holidays.

SUBSTITUTION POLICY

6.1 In the event that a student is deemed to have been placed in a level that is not appropriate for the type of programme or course chosen, the school reserves the right to relocate the student to a class appropriate to their level, which may have a lower number of teaching hours and different content. We also reserve the right to cancel any programme or course at short notice due to lack of demand.

6.2 In the event that a teacher notifies a change of availability or the end of the employment relationship with the school, Language Campus reserves the right to assign a substitute teacher for this training.

PAYMENT

7.1 Individual, Mini Group, Intensive, General Plus, Exam Preparation Courses. Payment of the full course fee must be made to the centre no later than 7 days before the course start date (due date).

7.2 All bookings are subject to acceptance by Language Campus.

7.3 Language Campus reserves the right to invoice the course fee at any time after acceptance of the booking.

7.4 All course fees must be paid in Euros.

7.5 The Centre reserves the right to increase the Course Fee by such amount as is reasonable in the circumstances by informing the Student at any time prior to the Course Start Date. Any increase in the Course Fee will be the result of any increase in costs to the Centre due to factors beyond its control, such as, but not limited to, increases in: tax increases, government measures and labour costs.

7.6 Any increase in the course fee shall not affect the students' legal right to cancel the contract.

7.7 Registration: at the beginning of all the training activities offered in the Language Campus catalogue, a registration fee must be paid.

7.8 Proof of payment. Language Campus may require the client to present documentary proof of payment of the course fee, both prior to the start of the course and at the start of the course. Failure to provide such proof may result in the denial of access to the course.

BOOKS AND LEARNING MATERIALS

8.1 During the course of their programme, learners will have the necessary books and learning materials available to them at all times. Some specialised programmes may require the purchase of books or manuals.

8.2 The cost of books will be reflected in the academy's catalogue according to the level and purpose of the course. In addition, those students in individual or mini-group classes who do not wish to purchase a book may request the delivery of photocopiable material for a fee of €15.

CANCELLATIONS

9.1 Individual and Mini Group Classes. Individual classes, mini-group classes, the individual portion of the General Plus and Intensive courses may be cancelled and rescheduled as long as there is a formal notification at least 24 hours prior to the scheduled class. Such notification must be made by WhatsApp directly to the academy's reception. Classes cancelled outside this period will be discounted and cannot be made up, rescheduled or reassigned.

9.2 All bank charges incurred by the centre in connection with the refund of any course fees or deposits shall be reimbursed by the Student without delay.

RETURNS

10.1 There is no refund for individual/mini group lesson vouchers.

10.2 For group courses, there is no refund of the amount paid, unless the minimum number of participants required to start the course (8 people) is not reached; the student is unable to attend for work reasons (subject to verification with a certificate issued by the employer), or the course has been opened at a different time to the availability provided at the time of booking.

CHANGE OF COURSE

11.1 Language Campus reserves the right to change or cancel a course, venue or facilities without notice in the event of unforeseen circumstances beyond its control; or where the level of bookings received does not reach the minimum number necessary to operate a course viably.

11.2 In the event of a change of course by Language Campus, the centre will offer an alternative course, venue or facilities or a refund (of fees paid) and you agree that you shall have no further claim against Language Campus in respect of any change of course.

RESPONSIBILITY

12.1 Language Campus shall not assume any liability to the Student for any loss, damages, costs, expenses or other claims for compensation arising in connection with the Student's participation in the Courses provided by Language Campus, except in relation to death or personal injury caused by the negligence of the centre or its employees.

12.2 Language Campus shall not assume any liability to the Student for any loss, damage, costs, expenses or other claims for compensation arising in connection with cancellation or delay of classes or as a result of any event or action beyond the control of the centre, including but not limited to traffic congestion, adverse weather, public transport and illness.

STUDENTS

13.1 Illness of students. In the event of illness or injury, Language Campus will follow the directions of the attending medical personnel, unless otherwise instructed by parents/guardians. In the event of a medical emergency, all students will be taken to the nearest hospital or outpatient clinic.

13.2 Language Campus reserves the right to take such fair and reasonable measures as it deems appropriate in the event that a situation arises that is not covered by these Conditions.

13.3 Absenteeism. Any participant who fails to attend each and every class that makes up the programme shall not be entitled to any refund for missed classes. Likewise, participants will forfeit the right to receive their course completion certificate unless they have attended 80% of the classes.

EXCLUSION AND EXPULSION

14.1 A Student shall be expelled from participation in courses provided by Language Campus if, in the reasonable opinion of the Centre, the Student has behaved in a way that amounts to gross misconduct.

The student will be expelled from the course with immediate effect and must return home, at the expense of his/her parents in the case of minors, as soon as possible. No refunds will be offered for the remaining days during which the student is expelled from the course.

Grounds for expulsion may include, but are not limited to, the following:

  • Purchase or use of illegal drugs,

  • Purchase or use of alcohol,

  • Involvement in violent or abusive behaviour,

  • Possession of weapons,

  • Any other serious crime.

14.2 Student Code of Conduct:

During their stay at Language Campus, students agree to abide by the policies and rules of the student code of conduct. As part of Language Campus' commitment to our students, we strive to provide them with the best possible learning environment, and as such, we expect them to behave in an exemplary and respectful manner towards others. Behaviour that is considered inappropriate includes the following:

  • Disturbances in the learning environment (foul language, bullying, use of mobile phones in class, etc.);

  • Deliberate destruction, misuse or theft of any property belonging to Language Campus or other students;

  • Violence or threats against other students, Language Campus staff or their property;

  • Inappropriate use of the Internet;

  • Violation of local criminal copyright laws prohibiting the appropriation, copying or modification of any copyrighted material; or

  • Failure to declare any pre-existing medical or mental health conditions.

COMPLAINTS

We work hard to ensure that you receive a service that meets your expectations. However, it is possible that, on occasion, you may not be completely satisfied with the service provided. All Language Campus staff are here to help you if you have any queries or problems. If you are not satisfied with the services provided, please follow the steps below in order to find the best solution to your problem.

  • Training: if you have any problems or queries regarding the lessons or your learning, please discuss them with your teacher in the first instance. If, after discussion with the teacher, you have not found a satisfactory solution or answer to your problem, please speak directly to reception.

  • Administration: if you are dissatisfied with any matter relating to the administration of your course, such as the handling of payments or course dates, please contact reception directly.

  1. Validity and resolution

The terms and conditions expressed herein apply to any contract agreed between LC IDIOMAS GC, SLU and any user of the portal. www.lcampus.co who places an order via the Internet (hereinafter referred to as "customer"), unless otherwise stated in the specific conditions of each particular course.

In case of modification, the general terms and conditions of sale in force on the day of the order shall apply to each order.

Any order implies full acceptance of these conditions.

Given that the courses are entirely online due to their nature (digital content), the right of cancellation will not apply in accordance with the provisions of article 103 letter m) Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

LC IDIOMAS GC, SLU reserves the right to modify the commercial offer of the website (modifications to products, prices, promotions and other commercial and service conditions) at any time, although these modifications will not be applied to contracts already made.

LC IDIOMAS GC, SLU reserves the right to assign the contractual position to any company that forms part of its group of companies in accordance with the provisions of article 42 of the Code of Commerce in accordance with article 18 of the Capital Companies Act.

LC IDIOMAS GC, SLU makes every effort within its means to offer the information contained in the website truthfully and without typographical errors. In the event of any error of this type occurring at any time, beyond the control of LC IDIOMAS GC, SLU, it will be corrected immediately.

  1. Applicable law and competent jurisdiction

All sales and purchases made with LC IDIOMAS GC, SLU are subject to Spanish legislation.

RESPONSIBILITY

The choice or purchase of a product or service shall be the sole responsibility of the customer: the total or partial impossibility of using the products due to incompatibility of the materials shall not give rise to any claim, reimbursement or legal action against LC IDIOMAS GC, SLU.

In cases where the courses involve the use of information technology, such as internet access, the client must have the necessary means to meet the technical requirements for accessing the courses. For this purpose, the client must have an up-to-date operating system and an internet connection with a bandwidth of no less than 50 Mbps and an up-to-date antivirus. LC IDIOMAS GC, SLU keeps its systems updated and takes the maximum guarantees to prevent identity theft techniques or computer viruses, however, LC IDIOMAS GC, SLU will not be responsible for possible damages that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operational functioning of the client, caused by reasons beyond the company's control; delays or blockages in the use of the courses caused by deficiencies or overloading of telephone lines or overloading of the Internet or other electronic systems, as well as damages that may be caused by third parties through illegitimate interference beyond the control of LC IDIOMAS GC, SLU.

RIGHTS AND DUTIES OF THE CLIENT

The client has expressly requested and received from LC IDIOMAS GC, SLU the necessary information about the course to be followed, with its characteristics, service, study fees and method of payment.

LC IDIOMAS GC, SLU undertakes to provide the client with the teaching content and online support necessary for the full development of the course in which he/she has enrolled, according to the study mode chosen.

LC IDIOMAS GC, SLU may issue and deliver to the client, once the course has been successfully completed and all the course fees have been paid, a Diploma or Document accrediting the studies completed, subject to payment of the fees for issuing and sending the said document. These studies have no official academic validity.

The client undertakes to pay the total amount of the Tuition Fees, Tuition Fees and Accreditation of Studies, in accordance with the conditions requested and agreed in this Contract, the rate of payment of the same being totally independent of the rate of payment of the studies. However, the client will be able to carry out his studies in less time than the contracted payment period, as long as he pays the receipts corresponding to the advanced lessons.

The client is obliged to keep the access codes to the online training area, as well as the rest of the study material, if any, and LC IDIOMAS GC, SLU reserves the right to keep them until the agreed fees have been paid in full, the registration being personal and non-transferable unless expressly authorised by LC IDIOMAS GC, SLU. The possible cancellation of the access codes and return of the study materials by unilateral decision of the student will not exempt him/her from complying in full with the terms of this contract.

The client acknowledges that he/she understands and sufficiently understands the Spanish language, as well as the contract that he/she voluntarily subscribes, expressly acknowledging that he/she has sufficient knowledge of the Spanish language, both oral and written, to take the course that he/she has contracted, and that he/she can therefore undertake the study and preparation of the same, carrying out, in the event that LC IDIOMAS GC, SLU considers it necessary, a comprehension test with answers in his/her own handwriting, being informed that the acquisition of the Course in no case facilitates, nor gives him/her the right to obtain, a work permit or residence permit in Spain.

The Client is solely responsible for ensuring that the information provided to LC IDIOMAS GC, SLU is complete, correct and true; likewise, the Client is solely responsible for keeping the contact details provided to LC IDIOMAS GC, SLU up to date. The communications made by LC IDIOMAS GC, SLU to the Client will be valid and will be fully effective as long as they are made to the contact details provided by the Client; in the event that the Client changes (e.g. address, telephone number, e-mail address), he/she must inform LC IDIOMAS GC, SLU.

LC IDIOMAS GC, SLU's mission is the preparation and provision of courses but in no case does it guarantee that the Client will obtain a job, promotion or increase their income.
