Your legal right to the Bildungsurlaub

In almost all German federal states, employed workers have a legal right to paid leave for certified training.

This also applies to language courses abroad, provided that the program is officially recognized and the venue meets the state's legal requirements.

NRW Notice — required by law

The AWbG NRW (§ 5) requires that the venue be located no more than 500 km from the state border. Gran Canaria falls outside this radius. Employees in NRW are not legally entitled to Bildungsurlaub for Language Campus courses. Basis: § 5 AWbG NRW, Ministry of Culture and Science of NRW.

Berlin — terminology update

The Berlin law was replaced in 2021 by the Berliner Bildungszeitgesetz (BiZeitG). The correct term is "Bildungszeit" (education. Full-time employees are entitled to 5 days per year, which can be accumulated up to 10.

Saxony — effective from 2027

Until December 31, 2026, there is no law regarding training leave in Saxony. From January 1, 2027, employees will be entitled to 3 days per year (law approved February 2026). Language Campus will verify the recognition of this leave for Saxony before that date.

Bildungsurlaub at Language Campus is not just about attending classes.

Do I need to book before applying for Bildungsurlaub?

No. We recommend: 1) Checking with Language Campus to find out what format your state requires. 2) Submitting the application with the documentation we provide. 3) Confirming the booking only after employer approval.

Yes, in most states. Federal laws do not restrict the venue to Germany in general. The most relevant exception is North Rhine-Westphalia with its 500 km rule (see table of states).

The AWbG NRW (§ 5) requires that the venue be no more than 500 km in a straight line from the state border. Gran Canaria falls outside that radius. There is no legal right to hold the event.

These are three different names for the same legal right. The term depends on the state: "Bildungszeit" in Berlin, BW and Bremen; "Bildungsfreistellung" in Brandenburg, Rh-Palatinate, Saarland, Saxony-Anhalt and SH; "Bildungsurlaub" in Hamburg, Hesse and Lower Saxony.

You have a legal right. The denial must be in writing and include a reasoned explanation. Language Campus provides sample appeals and legal grounds for each state.

Your company continues to pay your full salary during your Bildungsurlaub (leave of absence). The cost of the course, flight, and accommodation is your responsibility—usually tax-deductible as training expenses on your tax return.
