Terms and conditions of the website

PROVISION OF COURSES

1.1 LC Idiomas GC SLU, with headquarters at Calle República Dominicana, 17, 35010, Las Palmas de Gran Canaria, offers language courses subject to these Conditions, the booking and acceptance of which will constitute the "Contract".

1.2 The academy may modify these Conditions at any time in relation to future courses, and these will be published through this website.

1.3 If the course booked by the Student is no longer available, the academy will immediately inform the Student in writing or by email and will endeavor to offer an alternative course that is reasonably acceptable to the Student, but if this option is not possible, the academy has the right to cancel the Contract by notifying the student in writing to this effect and refunding any money already paid by the student for the course.

RESERVATIONS AND CONDITIONS OF COURSES AND PROGRAMS

2.1 Reservations for General Courses, Academic Year and Action English. The reservation fee for the General Course (€85), Academic Year (€95) or Action English (€65) must be paid in full before the start of the training in order to guarantee the reservation of the place in the requested course.

2.2 Booking individual and mini-group classes. The academy's reception reserves the right to release the time slot for individual or mini-group sessions if no response is received from the student regarding the renewal of the voucher within 24 hours of notification of the voucher's expiration.

2.3 Validity of the hourly voucher (individual and mini-group). Individual or mini-group class vouchers will be valid for a maximum of 8 weeks. For vouchers for 30 hours or more, this validity is extended to 15 weeks.

2.4 Booking a place in conversation classes. The process to book your place in a face-to-face or online conversation class must be done through the Conversation Class Form at least 24 hours before the scheduled class.

2.5 Cambridge Exam Preparation Courses. It is mandatory for all students to take the mock exam to access the preparation courses. Course admission will be subject to the results obtained and the recommendations made by the Academic Coordination team.

2.6. In the General Plus, Action English Plus, Conversation Plus, and Intensive courses, it is mandatory to attend the individual sessions within the 4-week course period. Once this period has passed, missed sessions cannot be made up.

2.7 Level tests for access to language training programs may not be carried out within the established academic hours.

*Certificate retention. Cambridge certificates are archived for a maximum period of 1 year from the date of notification of arrival.

2.8. Students may request changes or modifications to their accommodation by contacting our educational institution's customer service department at 928 90 90 54.

WITHDRAWAL, CANCELLATION, NO-SHOW AND/OR ABANDONMENT OF THE PROGRAM BY THE CONSUMER

3.1. If a consumer decides to cancel the contracted program, they must notify Language Campus in writing.

The consumer will be entitled to a refund of the amounts paid to Language Campus. However, the consumer must pay, and Language Campus may retain, the amount corresponding to damages caused to Language Campus, including all expenses of any kind incurred by Language Campus to date, including but not limited to: payments to third parties involved in the program: schools, residences, insurance companies, telephone calls, as well as any other infrastructure and/or logistical expenses, among others.

To inform the consumer of the approximate amount of the withholdings or charges that will be applied and regardless of their subsequent determination, the withholdings or charges for disposal will amount to:

  • Management fees are calculated at a minimum of €300, non-refundable.

  • 50% of the total program amount, if cancellation occurs between 20 and 45 days before the program start date.

  • 75% of the total program amount, if cancellation occurs between 10 and 20 days before the program start date.

  • 85% of the total program amount, if cancellation occurs between 3 and 10 days before the program start date.

  • 100% if the cancellation occurs within the previous 48 hours, or if the consumer does not show up for the departure date, or if, once the program has begun, they leave the program of their own volition, that of their parents or legal guardians, or are expelled from the program.

3.2 Withdrawals from the Action English, Academic Year, and General/Trimester courses must be notified before the 25th of the month prior to the month in which you wish to terminate the contract. To do so, you must send an email to mesaylopez@lcampus.co or 7palmas@lcampus.co with the student's full name, ID number, and the reason for withdrawal.

3.3. In the case of the Academic Year and the General/Trimester Course, withdrawal will only be possible for work-related reasons that prevent attendance (after verification with a certificate issued by the employer), health reasons (medical certificate) or change of residence outside the municipality of Las Palmas de Gran Canaria.

STATEMENT ON THE STATE OF HEALTH

4.1 Students must state on the application form if they suffer from any type of:

  • physical or mental illness,

  • allergy,

  • disability,

  • or any other condition that

    • may interfere with your ability to successfully complete the course;

    • may affect the health or well-being of any other student, teacher or staff member;

    • may require medical follow-up, treatment or emergency intervention of any kind during training.

Language Campus reserves the right to refuse enrollment to any student, or to terminate their training, if their continued participation could pose a risk to their own health and safety, or to that of any staff member. In such cases, Language Campus will decide on the applicable refund policy at its sole discretion.

HOLIDAYS

5.1 There will be no classes on public holidays, and the academy facilities will remain closed. All scheduled group course start dates fall on Mondays, unless it is a public holiday, in which case they will start the following day, Tuesday. No compensation will be given for classes not offered on public holidays.

REPLACEMENT POLICY

6.1 If, after the placement test, a student is deemed to have been placed at a level unsuitable for the chosen program or course, the academy reserves the right to relocate the student to a class appropriate to their level, which may have fewer class hours and different content. We also reserve the right to cancel any program or course at short notice due to insufficient enrollment.

6.2 In the event that a teacher notifies a change in availability or the end of the employment relationship with the school, Language Campus reserves the right to assign a substitute teacher for said training.

PAY

7.1 Individual, Mini Group, Intensive, General Plus, Exam Preparation, Online, and Blended Learning courses. Full payment of the course fee must be made to the center no later than 7 days before the course start date (payment deadline).

7.2 All reservations are subject to acceptance by Language Campus.

7.3 Payment for the monthly fees of the 'Action English' course must be made by direct debit. If payment is made at the academy reception, whether in cash, by card, or by bank transfer, a €5 surcharge will be added to the monthly fee to cover administrative costs. Payment must be made between the 1st and 10th of each month. Failure to comply with this condition may result in the student's immediate withdrawal from the course.

7.4 Payment of the monthly fees for the course called 'Academic Year' should preferably be made by direct debit. Payment can also be made at the academy's reception desk, in cash, by card, or by bank transfer, between the 1st and 10th of each month.

7.5 Payments will be renewed automatically unless one of the following measures is requested at least 10 days before the end of the term:

  • Change of charge account number

  • Application to withdraw as a student

7.6 Language Campus reserves the right to invoice the course fee at any time after the booking has been accepted.

7.7 All course price payments must be made in euros.

7.8 The center reserves the right to increase the course price by any amount that is reasonable under the circumstances, informing the student at any time before the course start date. Any increase in the course price will result from any increase in costs to the center due to factors beyond its control, such as, but not limited to, increases in: tax increases, government measures, and labor costs.

7.9 Any increase in the course price will not affect the students' legal right to cancel the contract.

7.10 Registration: At the start of all training courses offered in the Language Campus catalog, a registration fee of €25 is required. This fee includes administrative costs. For trimester courses, the registration fee is paid at the beginning of the training course and must be paid each subsequent trimester. For Academic Year courses and Action English or Aktion German courses, the registration fee must be paid at the beginning of each academic year.

7.11 Proof of Payment. Language Campus may require the client to provide documentary proof of payment for their course, both before and at the start of the course. Failure to provide such proof may result in denial of access to the course.

BOOKS AND LEARNING MATERIALS

8.1 Throughout their program, students will have access to the necessary books and learning materials at all times. Some specialized programs may require the purchase of books or manuals.

8.2 The cost of books will be reflected in the academy's catalog according to the level and purpose of the training. Additionally, students in individual or mini-group classes who do not wish to purchase a book may request photocopiable materials for a fee of €15.

CANCELLATIONS

9.1 Individual and Mini-Group Classes. Individual classes, mini-group classes, and the individual portion of the Action English, Conversation Plus, General Plus, and Intensive courses can be canceled and rescheduled provided that formal notification is given at least 24 hours in advance of the scheduled class. This notification must be made via WhatsApp directly to the academy's reception. Classes canceled outside of this timeframe will be deducted from the total cost and cannot be rescheduled, rescheduled, or reassigned.

9.2 All bank charges incurred by the center in connection with the refund of any course fee or deposit will be refunded by the student without delay.

RETURNS

10.1 Returned Payments for Action English and Academic Year Courses: Students who have opted for direct debit payment for their course will have a payment request generated in their bank account on the 1st of each month. If this request is returned, a penalty of €5 plus the returned monthly payment will be charged.

10.2 No refunds are permitted for vouchers for individual classes or mini groups.

10.3 In group courses, refunds are not permitted unless the minimum number of participants required to start the course (8 people) is not reached; the student is unable to attend due to work reasons (subject to verification with a certificate issued by the employer); or the course has been opened at a different time than the availability provided at the time of booking.

CHANGE OF COURSE

11.1 Language Campus reserves the right to change or cancel a course, its venue, or its facilities without prior notice in the event of unforeseen circumstances beyond its control, or when the level of bookings received falls below the minimum number necessary to operate a course viably.

11.2 In the event of a course change by Language Campus, the center will offer an alternative course, venue or facilities or a refund of the fees paid, and you agree that you will have no further claim against Language Campus in respect of any course change.

RESPONSIBILITY

12.1 Language Campus will not assume any liability to the student for any loss, damage, costs, expenses or other claims for compensation arising in connection with the student's participation in courses provided by Language Campus, except in connection with death or personal injury caused by the negligence of the center or its employees.

12.2 Language Campus will not assume any liability to the student for losses, damages, costs, expenses or other claims for compensation arising in connection with the cancellation or delays of classes or as a result of any event or action outside the control of the center, including, but not limited to, traffic jams, adverse weather, public transport and illness.

STUDENTS

13.1 Student Illness. In the event of illness or injury, Language Campus will follow the instructions of the attending medical staff, unless otherwise directed by a parent/guardian. In the event of a medical emergency, all students will be transported to the nearest hospital or clinic.

13.2 Language Campus reserves the right to take any fair and reasonable measures it deems appropriate in the event of a situation not covered by these Terms.

13.3 Absenteeism. Any participant who fails to attend each and every class included in the program will not be entitled to any refund for missed classes. Likewise, participants will forfeit the right to receive their course completion certificate unless they have attended 80% of the classes.

EXCLUSION AND EXPULSION

14.1 A student will be expelled from participating in courses offered by Language Campus if, in the center's reasonable opinion, the student has behaved in a manner that amounts to serious misconduct.

The student will be expelled from the course with immediate effect and must return home, at their parents' expense if they are a minor, as soon as possible. No refunds will be offered for the remaining days after the student is expelled from the course.

Grounds for expulsion may include, but are not limited to, the following:

– Purchase or use of illegal drugs,
– Purchase or use of alcohol,
– Involvement in violent or abusive behavior,
– Possession of weapons,
– Any other serious crime.

14.2 Student Code of Conduct:

During their stay at Language Campus, students agree to comply with the policies and rules of the Student Code of Conduct. As part of Language Campus' commitment to our students, we strive to provide them with the best possible learning environment, and therefore, we expect exemplary behavior and respect for others. Behaviors considered inappropriate include the following:

  • Disturbances in the learning environment (foul language, harassment or use of mobile phones in class, among others).

  • Deliberate destruction, misuse or theft of any item owned by Language Campus or other students.

  • To commit violence or make threats against other students, against Language Campus staff or against its property.

  • Inappropriate use of the Internet.

  • Violation of criminal copyright laws that prohibit the appropriation, copying, or modification of any copyrighted material.

  • Failure to declare any pre-existing medical or mental condition.

CLAIMS

We work hard to ensure you receive a service that meets your expectations. However, it is possible that, on occasion, you may not be entirely satisfied with the service provided. All Language Campus staff are at your disposal to assist you should you have any questions or problems. If you are not satisfied with the services provided, please follow the steps below to find the best solution to your problem.

  • Training: If you have any problems or questions regarding classes or your learning, please discuss them with your teacher first. If, after speaking with the teacher, you have not found a satisfactory solution or answer to your problem, please speak directly to reception.

  • Administration: If you are unhappy with any matter relating to the administration of your course, such as payment management or course dates, please contact reception directly.

1. Validity and resolution

The terms and conditions expressed herein apply to any contract agreed between LC IDIOMAS GC, SLU and any user of the portal www.lcampus.co who places an order through the Internet (hereinafter “customer”), unless otherwise established in the particular conditions of each specific course.

In the event of any modification to these terms, the general terms and conditions of sale in force on the day of the order will apply to each order.

Every order implies full acceptance of these conditions.

Since the courses are conducted entirely online due to their nature (digital content), the right of withdrawal will not apply in accordance with the provisions of article 103 letter m) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

LC IDIOMAS GC, SLU reserves the right to modify the commercial offer on the website (modifications to products, prices, promotions, and other commercial and service conditions) at any time, although such modifications will not apply to contracts already made.

LC IDIOMAS GC, SLU reserves the right to transfer the contractual position to any company that is part of its group of companies, in accordance with the provisions of Article 42 of the Commercial Code in conjunction with Article 18 of the Capital Companies Law.

LC IDIOMAS GC, SLU makes every effort to ensure that the information on this website is accurate and free of typographical errors. Should any such error occur, which is always unintentional on the part of LC IDIOMAS GC, SLU, it will be corrected immediately.

If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on that error, LC IDIOMAS GC, SLU will inform the customer of the error and the customer will have the right to cancel their purchase at no cost to them.

Payments must be made by credit card, bank transfer, or PayPal. This payment process is secure, and orders are registered and validated after the bank approves the payment.

In certain cases and to prevent possible fraud, LC IDIOMAS GC, SLU reserves the right to request a specific payment method from the Customer if the buyer's identity is not reliably verified.

10. Effect of the contract

A customer's request to purchase a course through the Portal is understood as the conclusion of a binding purchase agreement.

The aforementioned contract comes into force when the seller expressly accepts the purchase request or by providing the buyer with access to the online course within the minimum time necessary to verify bank validation.

The contract has a validity period of 12 months, beginning on the day the purchase is verified.

11. Contract modifications

The client cannot make any modification to the contract except in the case of express acceptance by LC IDIOMAS GC, SLU, and any type of change must be communicated immediately to LC IDIOMAS GC, SLU.

12. Closing a user account

LC IDIOMAS GC, SLU reserves the right to close a customer's access to www.lcampus.co in the event of:

  • Non-payment.

  • Actions against the code against intellectual property.

  • Failure to comply with any of the obligations arising from these general terms and conditions of sale or, where applicable, from the specific terms and conditions.

The client is responsible for complying with all applicable laws and regulations and the rules governing acceptable use of the solutions and applications. However, any use of the solutions provided by www.lcampus.co contrary to good faith is prohibited, including, but not limited to:

  • Use that is contrary to Spanish law or that infringes the rights of third parties, or the publication or transmission of any content that is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.

  • Altering or interfering by fraudulent means, platforms, solutions, emails or systems of other users or third parties without their authorization.

  • Cracks, program serial numbers, or any other content that infringes on the intellectual property rights of third parties.

  • The collection and/or use of personal data of other users without their express consent or contravening the provisions of the regulations in force at any given time relating to the protection of personal data.

  • The use of the domain's mail server and email addresses for the purposes of spam, mail bombing, phishing, escrow fraud, scam 419, pharming, spreading viruses (trojans, worms, etc.), or any other type of activity carried out with a sabotaging, fraudulent or criminal intent.

13. Applicable regulations and jurisdictional competence

This contract is of a commercial nature, and will be governed and interpreted in accordance with Spanish law and other applicable European regulations.

In the event of any type of disagreement or difference between the parties in relation to the interpretation, content or execution of the contract that is not resolved out of court by mutual agreement, the parties will submit to the territorial jurisdiction of the courts or tribunals corresponding to the registered office of LC IDIOMAS GC, SLU, waiving any other jurisdiction that may correspond to them, and provided that there is no express rule of an imperative nature in the other sense.
